These Marketplace Terms apply when you browse, post, save, or message in What’s Happening Marketplace (the “Marketplace”) in the What’s Happening app, operated by Macrae Heppler Enterprises (“we,” “us”). They add to our general Terms of Service and Privacy Policy; where they conflict about the Marketplace, these terms win. By posting a listing or sending a message you agree to them.
1. What the Marketplace is — and isn't
The Marketplace is a place for people in Southern Utah to list things they own and find each other. We are not a party to any sale. We don’t own, inspect, hold, ship, or guarantee anything listed, we don’t handle payment, and we don’t take a cut. Every deal is between the buyer and the seller.
2. Who can use it
- You must be at least 18 years old.
- To post, you verify a mobile phone number. It’s used to confirm you’re a real person and to limit spam; it is never shown to other users.
- Private sellers only. The Marketplace is for individuals selling their own things. Dealers, resellers, retailers, and anyone selling on behalf of a business may not post. Vehicle listings require you to confirm you’re a private seller.
- One person, one account. Don’t create extra accounts to get around limits or a removal.
3. Listing rules
- List only things you own and have the right to sell, located in Southern Utah.
- Be accurate: real photos of the actual item, an honest description and condition, and the real price. Don’t list something you don’t have or have already sold.
- Keep contact details out of listings — buyers reach you through in-app messages.
- Limits: up to 5 new listings a day and 15 a week, and no more than 2 vehicles listed at once.
- Listings run 14 days. To keep one going, you renew it by lowering the price by at least the minimum shown in the app; free listings can be renewed up to three times. You can mark a listing sold or take it down at any time.
4. What you can't sell
These are not allowed in the Marketplace:
- Firearms, ammunition, gun parts, and explosives.
- Real estate, including rentals and room shares.
- Anything stolen, counterfeit, or that you don’t have the right to sell.
- Alcohol, tobacco and vaping products, cannabis, drugs, and drug paraphernalia.
- Prescription medicine and medical devices that require a prescription.
- Live animals.
- Recalled products, and car seats, cribs, or other children’s products that don’t meet current safety standards.
- Weapons designed to injure, including knives sold as weapons, tasers, and pepper spray.
- Adult content and services of any kind.
- Services, jobs, tickets above face value, gift cards, and financial products.
- Personal information, accounts, or anything illegal under Utah or federal law.
This list isn’t exhaustive — we may remove anything we reasonably believe is unsafe, illegal, or not in the spirit of a neighbor-to-neighbor marketplace.
5. How listings are checked
Every listing is screened when it’s posted, by automated checks that include an AI model. Most go live right away; some are held for a person to review before anyone else can see them. Screening is a safeguard, not a guarantee — it doesn’t verify that an item is real, works, or is as described.
6. Messaging
- Buyers and sellers talk through in-app messages. We never show anyone’s phone number; you choose what to share.
- Be respectful. No harassment, threats, hate, spam, scams, or pressuring anyone to move off the app to pay.
- You can block a conversation at any time, and report it. We may read a conversation that’s been reported, and we may limit how many conversations and messages an account can send.
7. Views and saves
We count how many times a listing is shown to people and how often it’s opened and saved. The number of times a listing has been seen may be shown publicly once it reaches a minimum; sellers can see the full numbers for their own listings. These counts are approximate.
8. Meeting up and paying
You’re responsible for your own safety and for deciding whether to buy or sell. Meet somewhere public in daylight, inspect items before paying, and never send money before you’ve seen what you’re buying. See our safety tips. Any taxes, titles, registrations, or permits a sale requires are the buyer’s and seller’s responsibility.
9. Reporting and enforcement
Anyone can report a listing or conversation. Listings that several people report may be taken down automatically until we review them. We may remove any listing, close any conversation, limit any feature, or suspend any account that breaks these terms or that we reasonably believe puts people at risk — with or without notice. Where we can, we review reports within 24 hours.
10. Your content
You own your listings and photos. By posting, you give us a non-exclusive, royalty-free license to host, display, resize, and share them in the app and in promoting the Marketplace, for as long as they are listed and a reasonable time after. You confirm you have the right to post them.
11. No warranties; limitation of liability
The Marketplace is provided “as is.” We make no promises about any listing, item, user, or transaction. To the maximum extent the law allows, we are not liable for any loss, injury, or dispute arising from a listing, a message, a meeting, or a sale, and our total liability for any claim relating to the Marketplace is limited to USD $100.
12. Disputes between users
If you have a problem with another user, you agree to resolve it with them directly, and you release Macrae Heppler Enterprises and its team from claims arising out of those disputes. You agree to indemnify us against claims arising from your listings, messages, or sales, or your breach of these terms.
13. Deleting your listings or account
You can take down any listing in the app at any time. When you delete your account, we delete your listings, photos, saved items, and every conversation you were part of — for both people in it — except where we need to keep information for safety, fraud prevention, or legal reasons.
14. Changes and law
We may update these terms as the Marketplace changes; we’ll update the date above, and continued use means you accept the changes. These terms are governed by Utah law, and disputes will be resolved in the state or federal courts in Washington County, Utah.
