These Terms govern your use of the What’s Happening Southern Utah website and related services (collectively, the “Service”), operated by Macrae Heppler Enterprises. By accessing the Service you agree to these Terms. If you don’t agree, please stop using the Service.
1. What WHSU is
WHSU is a curated local guide for Southern Utah — events, dining, deals, outdoor activities, family content, and the developments reshaping the corridor. We aggregate information from partner data feeds, public sources, our own reporting, and collaborator contributions (including the family-focused desk we operate with @stgeorge_kids).
2. Content accuracy
We work hard to keep listings accurate, but the Service is provided “as is.” Event times move, restaurants close, deals expire, trail conditions change, and partner feeds occasionally publish stale data. Before showing up somewhere, verify directly with the venue or organizer. WHSU is not responsible for losses resulting from out-of-date, inaccurate, or third-party content.
3. Partner content, sponsorships & affiliates
Some content on the Service is sponsored or part of a paid partnership — including but not limited to:
- Sponsored event spotlights and partner ribbons.
- Featured business listings on the Dining and Deals pages.
- Partner-funded sections (e.g. “Greater Zion Presents” on Outdoors and Dining).
- Affiliate links to outfitters and booking platforms (we may earn a commission when you book).
- Promo codes provided by partners.
Sponsored placements are labeled. Editorial picks (“Macrae’s pick”) reflect our genuine opinions and are not paid for.
4. Deals & promotions
Deals listed on WHSU are offered and honored by the participating business, not by WHSU. The business sets the terms, expiration, quantity, and any blackout dates, and may modify or revoke a deal at any time. WHSU is not a party to your transaction with the business and is not responsible for goods, services, or refunds.
5. User submissions
When you send us a tip, partner inquiry, contact-form message, event submission, business correction, or any other content (“Submissions”), you grant WHSU a worldwide, royalty-free, non-exclusive license to use, edit, publish, and distribute that content in connection with the Service. You represent that:
- You own the rights to the content or have permission to share it.
- The content is accurate to the best of your knowledge.
- The content doesn’t infringe anyone’s rights, defame anyone, or violate any law.
We may edit Submissions for clarity, style, and length, or decline to publish them at our discretion.
6. Acceptable use
You agree not to:
- Scrape, mirror, or republish substantial portions of the Service without written permission.
- Use automated tools to overload the site or to extract partner data feeds.
- Submit false, misleading, defamatory, or illegal content.
- Impersonate a business or person, or claim a business listing you don’t own.
- Probe, scan, or test the vulnerability of our systems.
- Use the Service to harass, threaten, or harm others.
7. Intellectual property
The Service — including original editorial copy, photography, video, page layouts, branding, and code — is owned by Macrae Heppler Enterprises or its licensors and is protected by copyright, trademark, and other laws. Third-party content (partner logos, Google Places photos, embedded YouTube videos, Instagram embeds) remains the property of its respective owners. You may share links and short excerpts with attribution; broader reuse requires written permission.
8. Third-party links & embeds
The Service contains links to and embeds from third-party sites (Google Maps, YouTube, Instagram, outfitter booking platforms, partner websites). We don’t control those sites and aren’t responsible for their content, policies, or practices. Following a third-party link is at your own risk.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. Outdoor recreation in Southern Utah carries inherent risks; verify trail conditions, permits, weather, and your own fitness before heading out.
10. Limitation of liability
To the maximum extent permitted by law, WHSU and Macrae Heppler Enterprises won’t be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenues, or data, arising out of your use of the Service. Our total liability for any claim is limited to USD $100.
11. Indemnification
You agree to indemnify and hold harmless Macrae Heppler Enterprises and its team from any claim, loss, or expense arising out of your breach of these Terms, your Submissions, or your misuse of the Service.
12. Governing law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Washington County, Utah.
13. Changes
We may update these Terms from time to time. When we make material changes we’ll update the “last updated” date. Continued use of the Service after changes constitutes acceptance.
